Terms of Use

The Free Gelato Balancing App ("the app" or "the software") is operated by DONNU LTDA, a Brazilian limited company registered under CNPJ 65.082.197/0001-09, with its registered office at Rua Lorena, 649, Loja Parte, Padre Eustáquio, Belo Horizonte/MG, CEP 30.730-170, Brazil ("Donnu", "we" or "us").

The app is free software for balancing gelato and sorbetto recipes, where you can also save recipes, ingredients and experiment notes. It is available on the website freegelatobalancing.app and in the Android app, which opens the same software. These terms are an agreement between Donnu and you, the person who uses it.

To save your work you need an account. By creating one, you confirm that:

• you are at least 18 years old and legally able to accept these terms;
• the information you give us is true, accurate and kept up to date;
• you will keep your password secret and are responsible for everything done in your account; if you suspect unauthorized use, tell us at once;
• you will have one account per person, without creating accounts for others or sharing one account among several people.

The software is free: there is no subscription and no paid plan. We grant you a personal, non-exclusive, non-transferable and revocable license to use it under these terms.

We keep improving the software, so features, calculations, the ingredient database and the interface may change, be added or be removed at any time, without prior notice. We may also discontinue the software, in whole or in part.

The software is free. Separately, we sell digital books and guides and a custom recipe service. Purchases happen only on the website, never inside the Android app, and payment is processed by Stripe.

Each purchase follows the conditions shown on the product page at the time of purchase (price, currency, format, delivery and guarantee). Today those pages say:

• Books and guides are PDF files, available for download right after payment, with a 30-day money-back guarantee: if the book is not what you expected, reply to your receipt within 30 days and you get a full refund.
• The custom recipe service is paid in advance, and the recipe is delivered by email within 5 business days of receiving your brief. You get a full refund if you change your mind before sending the brief, or if we cannot deliver a recipe that meets the brief you sent.

These guarantees do not limit your statutory rights as a consumer. In particular, consumers in Brazil may withdraw from an online purchase within 7 days of the purchase or of receiving the product, with a full refund (Consumer Protection Code, art. 49), and consumers in other countries keep the rights granted by the law of their country. To ask for a refund, reply to your receipt or write to contact@freegelatobalancing.app.

You agree not to do, or let anyone else do, any of the following:

• use the software in breach of the law or of the rights of others;
• publish recipes, photos, names or texts that are unlawful, offensive, discriminatory or misleading, or that infringe someone else's intellectual property, image or privacy;
• access, or try to access, other people's accounts or data, or parts of the system you are not authorized to use;
• copy, resell, sublicense, decompile or reverse engineer the software, or extract the ingredient database in bulk, including by automated means (scraping);
• overload, disrupt or compromise the security or operation of the software or its infrastructure;
• use the service to send spam or to impersonate another person.

Breaching this section allows us to suspend or close your account.

The recipes, ingredients, notes and photos you add are yours. You grant Donnu a free, non-exclusive, worldwide license to host, store, reproduce, process and display that content only as needed to run the software for you, for as long as it stays in the app.

When you make your profile or a recipe public, anyone with the link can see it, and a password-protected profile can be seen by anyone who has the password. Do not publish anything you want to keep private. You can make content private again, or delete it, at any time.

You are responsible for the content you publish and confirm that you have the right to publish it.

The software, its code and design, the texts, the calculations, the ingredient database, the Free Gelato Balancing brand and all other material we provide belong to Donnu or its licensors and are protected by law. Using the software does not transfer any of these rights to you, beyond the license in section 3.

What you may do with books, guides and custom recipes you buy follows the conditions on their product pages.

The software calculates estimates from the composition data of ingredients, which are average values. Real ingredients vary by brand, batch, season and origin, and the result also depends on your equipment, your process and your measurements. The numbers (such as PAC, POD, solids, fat and MSNF) are a guide to support your decisions, not a guarantee of texture, taste, shelf life or safety.

You alone are responsible for what you produce and serve, including:

• food safety and hygiene: pasteurization, temperatures, storage and handling;
• allergens, and informing the people who eat your products about them correctly;
• the accuracy of the ingredients and quantities you enter;
• compliance with the rules that apply where you produce or sell, such as health licensing, labeling and nutrition information.

If you make gelato professionally, check your recipes and processes with a qualified professional and your local health authority. The nutrition and composition information in the app does not replace laboratory analysis.

The software is provided free of charge, "as is" and "as available". To the maximum extent allowed by law, we do not guarantee that it will work without interruptions or errors, that it will suit a particular purpose, or that the calculations, the ingredient data or the content will be complete, accurate or up to date. We may carry out maintenance and updates that make it temporarily unavailable. Keep your own copy of the recipes that matter to you.

To the maximum extent allowed by law, Donnu is not liable for indirect or consequential damages, loss of profits, revenue, data or business opportunities, or for losses caused by products you make with the help of the software, arising from the use of the software or from being unable to use it.

For paid products, our total liability is limited to the amount you paid for the product concerned.

Nothing in these terms excludes or limits liability that the law does not allow to be excluded, including your rights as a consumer under the Brazilian Consumer Protection Code (CDC) and the mandatory rules of your country.

We may suspend or close an account that breaches these terms or puts the security or operation of the software at risk, or when the law requires it. Where reasonable, we will tell you why.

You can delete your account at any time, in the app or on the website, under Profile, Delete account. See how to delete your account for what is deleted and what is kept.

Clauses that by their nature should survive the end of our relationship (such as intellectual property, food safety, limitation of liability and governing law) remain in force.

We may update these terms. The date at the top shows the version in force, and material changes are announced by email to account holders. If you keep using the software after a change takes effect, the new version applies; if you do not agree, you can delete your account.

You agree to receive communications from us by electronic means, such as email and notices in the software, including account emails and occasional emails asking for your feedback. You can reach us at contact@freegelatobalancing.app.

If any clause is found invalid, the others remain in force. Not enforcing a clause does not mean waiving it. These terms, together with the Privacy Policy, are the entire agreement between you and Donnu about the software.

These terms are governed by the laws of the Federative Republic of Brazil. The courts of Belo Horizonte, State of Minas Gerais, have jurisdiction over any dispute, without prejudice to the consumer's right to sue in the courts of their own domicile, as provided by the Brazilian Consumer Protection Code (CDC). Consumers living in other countries also keep the protection of the mandatory rules of their country.
